Newt Gingrich Issues Stark Warning on Judicial Overreach and “Coup d’état”

In a powerful address to the House Judiciary Subcommittee this week, former Speaker of the House Newt Gingrich raised alarm over what he termed an unprecedented “judicial coup d’état” resulting from rampant judicial overreach in recent years.

Gingrich's testimony highlighted a troubling trend of nationwide injunctions being imposed by lower court judges that he argues undermine the authority of the duly elected Executive Branch.

“This clearly violates the Constitution and more than 200 years of American history,” Gingrich asserted, emphasizing the significant threat that such judicial actions pose to the balance of powers that underpins American democracy.

The former Speaker detailed how, since President Trump took office, 64 out of 96 nationwide injunctions issued from 2001 to 2023 originated during his presidency, predominantly by judges appointed by Democratic presidents. He noted that in just the first six weeks since Trump’s return to the White House, 15 nationwide injunctions have already been imposed against his administration.

Gingrich described these actions as an attempt by unelected judges to micromanage the decisions of an Executive Branch that received 77.3 million votes from the American electorate.

This ongoing trend represents a clear pushback against the voters’ will and underscores a growing crisis in the judicial system.

Highlighting historical precedents, Gingrich invoked examples from the founding fathers, illustrating that the executive and legislative branches have the constitutional authority to reshape the judiciary when it overreaches.

He recalled President Thomas Jefferson's decision to abolish certain courts to rebalance power after observing judicial encroachment during his time, underscoring a historical framework for addressing today's challenges.

Gingrich urged the current Congress to take decisive action to reestablish the constitutional boundaries that ensure no single branch of government, particularly the judiciary, can acquire dictatorial powers. He proposed legislative measures such as the “No Rogue Rulings Act” as a critical step toward curbing judicial overreach.

“It's time for Congress to remind the courts that they don’t hold all the cards,” Gingrich declared, reiterating the need for a national understanding of the judiciary's role in relation to elected officials.

As Americans grapple with critical issues ranging from national security to public safety, Gingrich's message resonates with those who believe that restoring the balance of power is vital to preserving the principles of democracy.

The former Speaker’s call to action comes at a crucial time when the integrity of democratic institutions faces challenges from various ideological corners. By emphasizing the right’s commitment to upholding constitutional limits, Gingrich is ringing a bell that warns about the perils of judicial tyranny that could unravel the core of American governance.

It remains imperative for lawmakers to heed this warning and reaffirm the foundational principles laid out by the Founding Fathers, ensuring that decisions affecting the nation truly reflect the will of the people.
